Terms of Service

1. Agreement to Terms

By accessing or using CrankUp's website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services

CrankUp provides AI automation services including but not limited to WhatsApp AI chatbots, automation pipelines, custom AI agents, BI dashboards, AI-powered websites, and AI strategy sessions. All services are delivered as described in individual project agreements.

3. Client Obligations

Clients agree to provide accurate business information, necessary access to systems for integration, and timely feedback during the project delivery process. Delays caused by incomplete or late client inputs may affect delivery timelines.

4. Pricing and Payment

All prices are listed in AED (UAE Dirhams) and are exclusive of VAT unless stated otherwise. Payment terms are outlined in individual project proposals. A deposit is required before work commences. Full payment is due upon project completion and handover.

5. Intellectual Property

Upon full payment, clients own the deliverables created specifically for their project. CrankUp retains the right to use general methodologies, tools, and frameworks developed independently. CrankUp may reference the project in its portfolio unless the client opts out in writing.

6. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the engagement. This includes business data, technical specifications, pricing, and strategic information.

7. Limitation of Liability

CrankUp's total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific service in question. CrankUp is not liable for indirect, incidental, or consequential damages.

8. AI and Automation Disclaimer

AI systems are probabilistic and may produce unexpected outputs. CrankUp builds, tests, and optimises AI solutions to a high standard but does not guarantee 100% accuracy of AI-generated responses. Clients are responsible for monitoring and reviewing AI outputs relevant to their business operations.

9. Retainer Services

Monthly retainer agreements auto-renew unless cancelled with 30 days' written notice. Unused hours do not roll over. Retainer scope is defined in the service agreement.

10. Termination

Either party may terminate a project with 14 days' written notice. In the event of termination, the client will be invoiced for work completed to date. Retainer services can be cancelled with 30 days' notice.

11. Governing Law

These terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Any disputes shall be resolved through the Dubai Courts.
